General Terms and Conditions (GTC)
§ 1 Scope
The following terms and conditions apply to all orders placed through our online shop. Our offer is aimed exclusively at entrepreneurs within the meaning of § 14 of the German Civil Code (BGB); the conclusion of a contract with consumers (§ 13 BGB) is excluded. By placing an order, the customer confirms that they are acting in the exercise of their commercial or independent professional activity.
§ 2 Contracting party
The purchase contract is concluded with BIZZ Europe a.s., Korunní 2569/108, 101 00 Praha 10, Czech Republic.
§ 3 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the order button you place a binding order. The contract is concluded upon our order confirmation or delivery.
§ 4 Prices and shipping costs
All prices are net prices and are subject to statutory VAT plus any applicable shipping costs, unless stated otherwise.
§ 5 Payment
Payment is made via the payment methods offered during the ordering process. Card payments are processed via our partner Elavon. Activation of card acceptance by the acquiring partner is usually quick but may take up to 10 working days.
§ 6 Delivery
Delivery is made to the delivery address you provide. Delivery times and conditions are specified during the ordering process.
§ 7 Retention of title
The goods remain our property until full payment has been made.
§ 8 No right of withdrawal (B2B)
As the offer is aimed exclusively at entrepreneurs, there is no statutory right of withdrawal; the consumer right of withdrawal under § 355 BGB does not apply. Any voluntary return arrangements are set out in our return policy.
§ 9 Warranty
The statutory warranty rights apply.
§ 10 Liability
We are liable for damages in accordance with statutory provisions; liability for slight negligence is – except in the case of injury to life, body or health – limited to foreseeable damage typical of the contract.
§ 11 Dispute resolution
Information on online dispute resolution can be found in our Legal Notice.
§ 12 Final provisions
The law of the Federal Republic of Germany applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
